شروط الخدمة

١. القبول

باستخدامك iClinicOS (الموقع، الدashboard، الـ API، أي خدمة مرتبطة)، إنت بتوافق بالكامل على الشروط دي. لو مش موافق، متستخدمش الخدمة.

٢. متطلبات الحساب

• لازم تكون طبيب مُرخّص مُسجّل في نقابة الأطباء المصرية، أو عضو مُصرّح له من فريق العيادة.
• عمرك 18 سنة فأكتر.
• البيانات اللي بتدخلها صحيحة ومحدّثة.
• إنت مسؤول عن حماية كلمة السر — كل نشاط يحصل من حسابك مسؤوليتك.
• ممنوع مشاركة الحساب مع أي حد خارج فريق العيادة.

٣. الخطط والأسعار

فيه خصومات على الاشتراك السنوي (توفير حتى 20%) والاشتراك نصف السنوي (توفير 10%). بنحتفظ بحق تعديل الأسعار بإشعار مسبق 30 يوم.

٤. التجربة المجانية 14 يوم

• 14 يوم مجاناً — بدون كارت ائتمان.
• كل المميزات متاحة في الـ trial.
• بعد الـ 14 يوم، الحساب بيتحول لـ Read-only mode لحد ما تشترك.
• بياناتك بتفضل محفوظة لمدة 30 يوم بعد انتهاء الـ trial.
• تقدر تترقى لأي خطة في أي وقت.

٥. الدفع والاشتراك

• الدفع عبر Paymob، Fawry، Vodafone Cash، Instapay، أو بطاقات (Visa/MasterCard).
• الفواتير بتتبعت على الإيميل مع كل دفعة.
• كل الأسعار بالجنيه المصري وشاملة ضريبة القيمة المضافة (VAT).
• لو عندك فاتورة ضريبية (للشركات)، اتواصل معانا.

٦. التجديد التلقائي والإلغاء

• الاشتراك بيتجدد تلقائياً في نهاية كل دورة (شهرية/نصف سنوية/سنوية).
• تقدر تلغي التجديد التلقائي من الإعدادات → الاشتراك في أي وقت.
• لو ألغيت، الاشتراك يفضل شغال لحد آخر الدورة المدفوعة.
• في حالة فشل الدفع: 3 محاولات على مدار أسبوع، بعدها الحساب بيتعلق لحد ما تحدّث طريقة الدفع.

٧. الاستخدام المقبول

مسموح:

• استخدام النظام لإدارة عيادتك الشخصية أو عيادة إنت جزء من فريقها.
• إضافة بيانات مرضى حقيقيين بموافقتهم.
• استخدام الـ AI bot للتواصل مع مرضاك.

ممنوع:

• استخدام النظام لأي غرض غير قانوني.
• محاولة اختراق النظام أو الوصول لحسابات تانية.
• عمل reverse engineering للنظام.
• رفع محتوى ضار (malware, viruses).
• Spam أو إساءة استخدام الـ AI bot.
• مشاركة بيانات مرضى بدون موافقتهم.
• إعادة بيع الخدمة أو إعادة توزيعها.

٨. الملكية الفكرية

كل الكود، التصاميم، العلامات التجارية، الشعارات، والمحتوى في iClinicOS ملكية iClinicOS. بياناتك وبيانات مرضاك ملكيتك إنت — إحنا بنحفظها فقط.

٩. التحذيرات الطبية (مهم جداً)

• الـ AI bot بيرد على المرضى بردود عامة — مش بيشخّص ولا بيصف دوا.
• AI Health Insights في ملف المريض اقتراحات بس — مش تشخيص رسمي.
• القرار النهائي لأي إجراء طبي = القرار بتاعك.
• في حالات الطوارئ، المريض لازم يروح مستشفى فوراً — iClinicOS مش للـ emergencies.

١٠. حدود المسؤولية

iClinicOS ليست مسؤولة عن:

• أي قرار طبي بتاخده بناءً على معلومات في النظام.
• أضرار ناتجة عن سوء استخدام النظام أو إهمال في حفظ كلمة السر.
• انقطاعات الخدمة القصيرة المعتادة (بنستهدف uptime 99.5%).
• أضرار غير مباشرة أو عرضية أو تبعية.
• أفعال أطراف تالتة (مثلاً Paymob، Resend) خارج سيطرتنا.

المسؤولية الإجمالية للشركة محدودة بـ قيمة ما دفعته في آخر 12 شهر.

١١. التعويض

بتوافق إنك تعوّض iClinicOS وتحميها من أي مطالبات أو أضرار ناتجة عن:

• انتهاكك للشروط دي.
• استخدامك غير القانوني أو غير الأخلاقي للنظام.
• معالجتك لبيانات مرضى بدون موافقتهم.
• قرارات طبية بتاخدها.

١٢. إنهاء الخدمة

إلغاء من طرفك:

تقدر تلغي حسابك في أي وقت من الإعدادات. قبل الإلغاء، صدّر بياناتك (Export JSON/CSV) — بعد 30 يوم من الإلغاء، بنحذفها نهائياً.

إيقاف من طرفنا:

بنحتفظ بحق إيقاف الحساب في حالة:

• انتهاك الشروط.
• عدم الدفع بعد 30 يوم من انتهاء المهلة.
• نشاط مُضِر بالنظام أو بالمستخدمين التانيين.
• طلب رسمي من جهة قانونية.

١٣. القانون والاختصاص القضائي

الشروط دي خاضعة لـ قوانين جمهورية مصر العربية. أي نزاع بيتم حله أول عبر التفاوض الودي خلال 30 يوم. لو مفيش اتفاق، الاختصاص القضائي لمحاكم القاهرة الاقتصادية.

١٤. تعديلات الشروط

ممكن نعدل الشروط دي. التعديلات الجوهرية بنبلغك بيها بالإيميل 30 يوم قبل سريانها. الاستمرار في استخدام النظام = موافقة على التعديلات.

١٥. التواصل

Terms of Service

1. Acceptance

By using iClinicOS (the website, dashboard, API, or any related service), you fully agree to these terms. If you do not agree, do not use the service.

2. Account requirements

• You must be a licensed physician registered with the Egyptian Medical Syndicate, or an authorized member of a clinic team.
• You must be 18 years or older.
• Information you provide must be accurate and up to date.
• You are responsible for password security — all account activity is your responsibility.
• Account sharing with anyone outside the clinic team is prohibited.

3. Plans and pricing

Annual subscription discounts (save up to 20%) and 6-month discounts (save 10%). We reserve the right to modify pricing with 30 days' prior notice.

4. 14-day free trial

• 14 days free — no credit card required.
• All features available during trial.
• After 14 days, account transitions to read-only mode until subscription.
• Your data is retained for 30 days after trial end.
• You can upgrade to any plan at any time.

5. Payment and subscription

• Payment via Paymob, Fawry, Vodafone Cash, Instapay, or cards (Visa/MasterCard).
• Invoices are emailed with each payment.
• All prices are in Egyptian Pounds and inclusive of VAT.
• For tax invoices (companies), please contact us.

6. Auto-renewal and cancellation

• Subscriptions auto-renew at the end of each cycle (monthly/6-month/annual).
• Cancel auto-renewal from Settings → Subscription at any time.
• If you cancel, the subscription remains active until the end of the paid cycle.
• On payment failure: 3 attempts over a week, then the account is suspended until payment method is updated.

7. Acceptable use

Allowed:

• Using the system to manage your own or your team's clinic.
• Entering real patient data with their consent.
• Using the AI bot to communicate with your patients.

Prohibited:

• Unlawful use.
• Attempting to breach the system or access other accounts.
• Reverse engineering the system.
• Uploading harmful content (malware, viruses).
• Spamming or abusing the AI bot.
• Sharing patient data without consent.
• Reselling or redistributing the service.

8. Intellectual property

All code, designs, trademarks, logos, and content in iClinicOS belong to iClinicOS. Your data and your patients' data belong to you — we only store them.

9. Medical disclaimers (very important)

• The AI bot responds to patients with general replies — it does not diagnose or prescribe.
• AI Health Insights in patient files are suggestions only — not formal diagnoses.
• The final decision for any medical action = your decision.
• In emergencies, patients must go to a hospital immediately — iClinicOS is not for emergency use.

10. Limitation of liability

iClinicOS is not liable for:

• Any medical decision you make based on information in the system.
• Damages from system misuse or password-negligence.
• Normal brief service interruptions (we target 99.5% uptime).
• Indirect, incidental, or consequential damages.
• Third-party actions (e.g., Paymob, Resend) outside our control.

Total company liability is limited to the amount you paid in the last 12 months.

11. Indemnification

You agree to indemnify and hold iClinicOS harmless from claims or damages arising from:

• Your breach of these terms.
• Your unlawful or unethical use.
• Your processing of patient data without consent.
• Medical decisions you make.

12. Termination

By you:

You can cancel your account at any time from settings. Before cancellation, export your data (JSON/CSV) — we permanently delete it 30 days after cancellation.

By us:

We reserve the right to suspend the account for:

• Terms violation.
• Non-payment 30 days after grace period.
• Activity harmful to the system or other users.
• Official request from a legal authority.

13. Governing law and jurisdiction

These terms are governed by the laws of the Arab Republic of Egypt. Any dispute is resolved first through amicable negotiation within 30 days. If unresolved, jurisdiction lies with the Cairo Economic Courts.

14. Changes to terms

We may modify these terms. Material changes will be emailed to you 30 days before they take effect. Continued use = acceptance.
